Our Spam Policy

ItsInTheMail's - Anti-Spam Policy

Definition of spam.

Our interpretation of spam is "It's spam if it is both unsolicited and bulk and has no inferred connection to the receiver or receivers".
  • Unsolicited email can be normal email, (examples include first contact enquiries, job enquiries, sales enquiries, etc.)
  • Bulk email can be normal email, (examples include subscriber newsletters, discussion lists, information lists, announcements, etc.)
Our technical definition of spam is
  • the recipient's personal identity and context are irrelevant because the message is equally applicable to many other potential recipients; AND
  • the recipient has not verifiably granted deliberate and explicit permission for it to be sent, i.e opted-in, subscribed to receive the received email; AND
  • the transmission and reception of the message appears to the recipient to give a disproportionate benefit to the sender.
Policing Spam

ItsInTheMail monitors all large imported lists and all emails going to large lists. If a client is found to be using to send spam, we reserve the right to immediately suspend that clients account.

If you are uploading lists to ItsInTheMail, you must explicitly certify that your lists consist of 100% certifiable opt-in email addresses.

ItsInTheMail reserves the right to request such proof, and the clients inability to supply it may result in the suspension of their account.

An unsubscribe link is annexed by ItsInTheMail to the footer of every outgoing email. Any efforts to disable, this will result in an immediate suspension of the clients account.

ItsInTheMail does not tolerate spam in any way whatsoever and will rigorously enforce its moral and ethical ideals in this regard. Any service that we provide is on the assumption that the mailing lists provided by our clients have been legally gained and that the people on them have had full opportunity to opt-in and opt-out at all stages of the pursuant mailing relationship.

Violations of our Terms of Service or this Spam Policy may result in legal action against you and the termination, without notice, of your company account.

Nothing in our policy is intended to grant any party the right to transmit email to or through ItsInTheMail server systems to persons who have not legally and legitimately supplied the email address for the purpose that the second party pursues. However, ItsInTheMail notes that any deceit in your relationship to us that results in formal complaints to us (ItsInTheMail) we are morally and legally obliged to pursue the Australian Spam Act and notify the appropriate authorities immediately.

How to avoid getting or sending Spam
  • Dont use purchased lists.
  • Dont send your H-MAILs to discussion groups.
  • Make sure your subject line and email content doesnt contain false or misleading information.
  • Make sure that your list is 100% opt-in, and on mailing you must have one legitimate opt-out, two is now 'industry's best practice'.
  • Keep records of where you got the email addresses from.
